The Charter of the Administration and Departments

THE CHARTER

of the Head Administration

 

I. General provisions:

1.1. The Head Administration is the functional component of the Association “Uzulgurjisavdoinvest” and in its activities follows and the Resolution PQ-1514 of the President of the Republic of Uzbekistan on “the Reformation of the structure and increasing performance appraisal of the Association “Uzulgurjisavdoinvest”, cultivates agricultural products, their reproduction, builds storage houses for fruits and vegetables, to organize modernization works with the order N105 of the Cabinet of Ministers from April 7, 2011, on “Measures to develop and consolidate material-technical base of storing fruits and vegetables for the years 2011-2015”, also, the laws of the Republic of Uzbekistan, decrees of the President of the Republic of Uzbekistan, the tasks of State councils, the Senate of Oliy Majlis and Legislative Chamber, the orders of the Cabinet of Ministers, resolutions, meeting summaries, instructions, also, the orders of the Association “Uzulgurjisavdoinvest”, Administrative orders, provides the organization of supervision over the execution of citizens’ appeals and organizes personnel development.

 1.2. The present Charter is the foundational-legal base for the tasks, credentials and function.

1.3. The Head Administration in its functions follows the laws of the Republic of Uzbekistan, decrees of the President of the Republic of Uzbekistan, the tasks of State councils, the Senate of Oliy Majlis and Legislative Chamber, the orders of the Cabinet of Ministers, resolutions, meeting summaries, instructions, also, the orders of the Association “Uzulgurjisavdoinvest”, Administrative orders, also, the orders of the Cabinet of Ministers 12 on “Consolidation of execution discipline” from January 12, 1999 and 62 on “the regulations of the Cabinet of Ministers” from February 14, 2005, the “ORDER” on the “Organization of relations with ministries, state committees, organizations, economic unions, organizing working with documents in their corporative and regional departments and monitoring of the condition of execution discipline” approved by the Cabinet of Ministers on August 30, 2009, also, the Regulations and guidelines 22-1 on “the organization of functions of wholesale trade companies and execution discipline” approved by the Cabinet of Ministers on September 22, 2009, and the present Charter.

1.4. The Head Administration functions under the leadership of the director of the Association “Uzulgurjisavdoinvest” and follows the director of the Association in its daily activities.

1.5. The Head Administration carries out its activities in cooperation with the Central Board of the Association and its departments, corporations under the system.

II. Main objectives of the Head Administration:

2.1. Organizes work on the development and consolidation of material and technical base of wholesale trade enterprises under the Association, provision of construction, reconstruction and modernization of special storehouses for ready-made food products and fresh fruits/vegetables, moreover, equipping storehouses with modern trade and cooling facilities, creating intensive gardens, establishing poultry farms and fish-breeding farms.

2.2. Participates in the drawing of projects and organization of their execution on the development of fruits and vegetables, market gardening, poultry farming, fish-breeding;

2.3. Gives recommendations on producing high quality products complying with the world standards and ecologically pure, organizes the activities of mini factories specialized in reproducing fruits and vegetables and their export;

 

2.4. Executes the monitoring of providing high standard seeds of vegetables and farm gardening products and vine;

 

2.2.Prepares recommendations on measures need to be taken to improve the material technical base of the wholesale bases under the system;

2.3. Provides products of cattle husbandry, poultry, fish for the domestic market and implements Projects to develop these sectors, also, supervises the execution of these projects;

 

2.4. Gives recommendation on planning of field for food crops;

 

2.5. Reviews the technical and economical projects of reproducing and establishing cattle-breeding, poultry and fish farms, prepares summaries and recommendations with experts;

2.6. Implements future and Addressed programs of construction, reconstruction and modernization of refrigeration capacities, construction of storage houses and presents to the administrative bodies of the Association for approval;

2.7. Executes monitoring of fulfillment of projects included into the program in accordance with the schedule and in timely manner;

2.8.Presents necessary information to the administrative bodies of the Association, the Cabinet of Ministers and other requiring bodies in prescribed periods;

2.9. Possess a base of information on conditions of purchasing appliances, facilities, materials and their prices for the construction, reconstruction and modernization of storage houses, and supplying local/foreign companies, and presents this information to the bases on request of the wholesale bases;

2.10. Organization work process through an electronic document exchange system and establishes Information Communication Technologies;

2.11.Assists member regional wholesale bases under the Association in the following regards:

-Implementing programs on improving material-technical base of companies;

-Negotiating with local governments on the issues of cultivating crops, intensive gardening, cattle-breeding, and fish-breeding farms, reproducing agricultural products, allotting lands for constructions and connecting to the system of communications;

-Organizing supply of plants, seeds, fertilizers, machines and materials for greasing fuels for gardens and crop fields;

-preparing project budget estimations for planned objects;

-Finding beneficial contractors for construction, reconstruction and modernization works;

-Resolving the issuance of credits by banking organizations for financing the planned activities.

2.12. Organizes timely execution of the laws of the Republic of Uzbekistan, decrees of the President of the Republic of Uzbekistan, the tasks of State councils, the Senate of Oliy Majlis and Legislative Chamber, the orders of the Cabinet of Ministers, resolutions, meeting summaries, instructions, also, the orders of the Association “Uzulgurjisavdoinvest”, Administrative orders, provides the organization of supervision over the execution of citizens’ appeals and organizes personnel development; functioning through electronic documents exchange system, establishing Information Communication Technologies, monitoring of execution discipline and analysis and sending reports on results of the above mentioned activities to the Central Board of the Association in prescribed periods;

2.13. Organizes acceptance of citizens by the heads of the Association, and the monitoring of reviewing the issues contained in written and oral appeals of citizens by regional wholesale companies;

2.14. Methodic administration of organizing execution discipline in the departments and branches of the Central Board of the Association “Uzulgurjisavdoinvest”, and organizes trainings for the personnel on this regard;

2.15. Methodic administration of organizing on solution of shortcomings in companies under the system, and departments and branches of the Central Board and informs the head director and deputies about the failures to meet standards;

2.16. Organizes timely execution of works in accordance with the orders of the Cabinet of Ministers 12 on “Consolidation of execution discipline” from January 12, 1999 and 62 on “the regulations of the Cabinet of Ministers” from February 14, 2005, the “ORDER” on the “Organization of relations with ministries, state committees, organizations, economic unions, organizing working with documents in their corporative and regional departments and monitoring of the condition of execution discipline” approved by the Cabinet of Ministers on August 30, 2009;

2.17. Manages collection files of private documents and T-2 private cards of the personnel of the Association, enters necessary documents to the cards in a timely manner and provides signing of the cards with the personnel;

2.18. Makes the schedule of vacations and ensures the completion of vacations by 25th of the last month of the year and fully informs the director about vacation schedule;

2.19. Legalizes sick-leave certificates and presents to the accounting office;

2.20. Prepares certificates on workplace and position of the workers when necessary;

2.21. Officially legalizes the newly-accepted personnel;

2.22. Regularly updates staff schedule and information on work experience. Prepares documents for retiring personnel and personnel receiving rewards; manages the issues of participants of world wars and honorary people of labor and international soldiers and those who are equaled to them; prepares documents for financial reinforcement by order of the directors.

2.23. Gives recommendations on the issues within the authority of the administration and offers methodic and practical assistance;

2.24.Prepares the documents on the issues included into the agenda of the meetings of the Head Administration of the Association “Uzulgurjisavdoinvest”.

III. The rights and obligations of the Head Administration:

The Head Administration exercises the following rights in carrying out its functions and objectives:

3.1. Represents the Association on the issues within the authority of the Administration;

3.2. Holds meetings and events in a prescribed manner on the issues within the authority of the Administration;

3.3. Collects and requests materials and information necessary to carry out assigned tasks and functions from the Central Board of the Association “Uzulgurjisavdoinvest” and its departments in a prescribed manner;

3.4. Monitoring of fulfillment of the contracts made between reproducing small companies and suppliers, the fulfillment of agro-technical measures and provides suggestions and instructions;

3.5. Holds events and meetings within the frame of the Head Administration, invites experts, researchers, higher educational organizations and other organizations to these meetings;

3.6. Studies the conditions of the companies under the system and the Central Board upon the request of the Association directors, reviews all materials and documents, also, participates in meetings and events;

3.7. Resends the appeals directed to the Association to their authors if the issues they contain are not within the authority of the Association based on legal documents;

If the issues are under the authority of the Association, participates in preparing necessary documents for projects together with other departments of the Association, organizes their execution and controls their execution;

3.8. If the execution terms of the documents are not appointed by the director and his deputies, based on Guidelines on the Regulations, order of administration and execution discipline of the Association, appoints the terms of the execution of documents;

Liabilities of the Head Administration:

3.14. The Head Administration is liable for the timely execution of decrees of the President of the Republic of Uzbekistan, the tasks of State councils, the Senate of Oliy Majlis and Legislative Chamber, the orders of the Cabinet of Ministers, resolutions, meeting summaries, instructions, also, the orders of the Association “Uzulgurjisavdoinvest”, Administrative orders by the departments of the Association.

IV. The Structure of the Head Administration and Management of its activities:

4.1. The Head Administration consists of 3 departments: Cultivation of agricultural crops, construction and modernization; Reproduction of agricultural products; Execution control and personnel development; the following personnel work in the Administration: a director, appointed by the Head Director, 2 Deputies of the director of the Administration, 1 Head of Department, 1 Deputy Head of Department, 3 Head Specialists and 1 Manager.

4.2. The structure of the Head Administration is approved by the director of the Association “Uzulgurjisavdoinvest”.

4.3. Head Director, Deputies of the director of the Administration, Head of Department, Deputy Head of Department, Head Specialists and Managers are appointed and faired by order of the Head Director of the Association in prescribed manner.

 4.4. The Director heads the Head Administration. The Director of the Head Administration follows the Head Director of the Association and his Deputy. The Director is appointed and faired by order of the Head Director of the Association in prescribed manner.

4.5. The personnel of the Head Administration abide the director of the Head Administration; they are appointed and faired by order of the Head Director of the Association with the recommendation of the Director of the Head Administration.

4.6. The Director of the Head Administration manages the activities; realizes its rights and obligations based on the tasks assigned to the administration.

4.7. The Director of the Head Administration bears full responsibility for quality and timely completion of the assigned tasks and labor and execution discipline.

4.8. The tasks of the Director of the Head Administration and other personnel are instructed in the Guidelines for Positions of the all personnel of the Association.

4.9. The activities of the Head Administration are carried out in accordance with the Charter of the Wholesale Trade bases, the Guidelines for activities of the Association, Regulations, Work Order and the present Charter, the tasks assigned by the Head Director and Deputies, the orders of the Association, summary orders and, also, the work plans of the Head Administration.

4.10. The Head Director approves the work plans of the Head Administration.

V. Mutual relations of the Head Administration with other departments of the Association

5.1. The mutual relations of the Head Administration with other departments of the Association are regulated by the present Charter and the Charters of the department.

 

VI.  Liquidation and Reorganization of the Head Administration

6.1. The Head Administration can be liquidated or reorganized by order of the Head Director in a prescribed manner.

 

 

2). THE CHARTER

of the Management Department of Purchase, Storage and Sale of Food Products and Fruits and Vegetables

 

I. General provisions

1.1.   The present Charter is designed in line with the Resolution PQ-1514 of the President of the Republic of Uzbekistan on “the Reformation of the structure and increasing performance appraisal of the Association “Uzulgurjisavdoinvest”, from March 30, 2011, the Association "Uzulgurjisavdoinvest" (hereinafter referred as the Association) assigns main tasks of the Management Department of Purchase, Storage and Sale of Food Products and Fruits and Vegetables (hereinafter referred as the Department).

1.2. The Management Department of Purchase, Storage and Sale of Food Products and Fruits and Vegetables is a constituting department of the Association "Uzulgurjisavdoinvest".

1.3.  The Department functions in accordance with the current legislature of the Republic of Uzbekistan, the Charter, orders, decrees of the Association, also, the present Charter.

II. Main objectives of the Department

2.1.    Management of purchase, storage and sales of food products and fruits and vegetables of wholesale trade bases which are the members of the Association;

2.2.  To the member regional wholesale trade bases:

-establishing middle and long term contract relations between the producers of food products and wholesale bases;

-organizing an uninterrupted supply of food products for retail trade companies, especially, companies situated in mountainous areas with difficult access;

-making orders to produce and deliver food products for sale;

-preventing storage of low marketable and low-quality food products in reserves;

-using storage houses and refrigeration capacities effectively;

- Purchase of fruits and vegetables, potatoes from farmers and peasant farms, storing these products and ensure uninterrupted provision of the population with these products in winter-spring season;

-organizing and counseling the processes of receiving and storing food products and delivering to retail trade branches and offering methodical/practical assistance;

2.3.  Market research of economic changes at domestic consumer market, particularly, taking measures to offer retail trade of socially important food products in populated areas difficult to access and located in distant regions of the Republic;

 

2.4.   Making suggestions on importing food products which cannot be supplied by local producers in amounts to satisfy the demand of the population and making cooperation with the regarding departments of the Association;

2.5.       Taking measures to supply the population in all parts of the Republic continuously with socially important food products;

2.6.       Making recommendations on creating favorable conditions for retail trade bases

Under the Association;

2.7.    Organizing management of trade fairs of agricultural products by the regional bases;

2.8.    Preparing analysis based on the fast information necessary for organizing trade fairs of agricultural products, and the functions of wholesale trade bases and presenting the Cabinet of Ministers;

2.9.    Timely delivery of regulatory documents, instructions, recommendations regarding the activities of wholesale trade to the wholesale trade bases which are members of the Association;

2.10. Reviewing the projects of regulatory documents regarding food products, laws, government orders and preparing summaries and suggestions;

2.11. Preparing reports regarding the activities of the Department and sending to the heads of the Association;

2.12. Giving comments and recommendations within the authority of the Department;

2.13.  Reviewing citizens’ appeals regarding the issues within the authority of the Department and preparing summaries and orders;

2.14.  Preparing materials for the issues on the agenda of the administrative meeting regarding the Department based on the work plans of the Association "Uzulgurjisavdoinvest".

III. Rights of the Department

The Department exercises the following rights:

3.4.         Representing the Association in the issues within the authority of the Department.

3.5.         Holding meetings and other events regarding the issues within the authority of the Department.

3.6.         Receiving information and reports from member companies within the authority of the Department.

IV. Management of the Department

4.1 The Department carries out its activities based on the approved plan.

4.2. Director heads the Department. The Director of the Department abides the Head of the Administration of the Association, and appointed and fired by order of the Head of the Administration.

4.3. The personnel of the Department abide the Director of the Department and are appointed and fired by order of the Director of the Association based on the recommendation of the Director of the Department.

4.4 The Director of the Department manages and directs the functions of the department. Within the frame of tasks assigned to the Department, exercises its rights and obligations.

4.5. The Director of the Department bears full responsibility for quality and timely completion of the assigned tasks and labor and execution discipline.

4.6. The tasks of the Director and other personnel of the Department are instructed in the Guidelines for Positions of the all personnel of the Association.

V. Mutual relations of the Department with other departments of the Association

5.1. The mutual relations of the Department with other departments of the Association are regulated by the present Charter and the Charters of the department.

 

 

 

3) THE CHARTER

of the Department of Development, Organization and  Generalization of the Activities of the Wholesale Bases under the System of the Association

 

I. GENERAL PROVISIONS

1.1. The present Charter is designed in accordance with the decree PQ-1871 of the President of the Republic of Uzbekistan from December 3, 2012 on “Further Development of the structure of the state and economy administrative bodies and the measures to make the number of the administration personnel acceptable”, and the previous Charter of the association of the Department of analysis and management of organizational changes and the State shares.

1.2. The Department of Development, Organization and Generalization of the Activities of the Wholesale Bases under the System of the Association (hereinafter referred as “DEPARTMENT”) follows the laws of the Republic of Uzbekistan, decrees of the President of the Republic of Uzbekistan, the tasks of State councils, the Senate of Oliy Majlis and Legislative Chamber, the orders of the Cabinet of Ministers, resolutions, meeting summaries, instructions, also, the orders of the Association “Uzulgurjisavdoinvest”, Administrative orders, guidelines and the present Charter in its functions.

1.3. The staff and the structure and the amendments shall be approved by the Head Director of the Association “Uzulgurjisavdoinvest”.

II. MAIN OBJECTIVES OF THE DEPARTMENT

2.The followings are the main objectives of the Department:

2.1.  Based on the contract on mutual cooperation and obligations of the parties, organizing and counseling the processes of receiving and storing food products and delivering to retail trade branches and offering methodical/practical assistance;

2.2. Organizing trade in regional wholesale bases on behalf of the Association, improving the supply system, participating in creation of necessary measures regarding other essential issues within the authority of the Department;

2.3. Preparing collected analytical reports and information on the regional wholesale bases under the system including bases with state shares and regularly presenting information requested to the Cabinet of Ministers and the State Committee of Privatization, Demonopolization and Development of Competition in established periods.

2.4. Organizing active participation of wholesale trade bases in celebrations of Navruz and the Independence Day holidays and other events in line with the specific instructions of the Cabinet of Ministers, receiving collected-analytical information on sponsorship activities to the funds “Mehribonlik”, “Sakhovat”, old-people’s homes and nursing homes, hospitals, honorary participants of wars and labor, also, needy retired people in cooperation with local governments and presenting reports to the Cabinet of Ministers in prescribed periods.

III. THE RIGHTS OF THE DEPARTMENT

3. The Department of Development, Organization and Generalization of the Activities of the Wholesale Bases under the System of the Association exercises the following rights:

3.1. Based on the instructions of the director of the Association “Uzulgurjisavdoinvest”, functions in all government and social organizations on behalf of the Association within the authority of the Department;

3.2. Receives information on wholesale/retail trade commodity circulation and others of customer goods from all wholesale trade bases under the system for the use of the Department;

3.3. To present to the Cabinet of Ministers at the end of each quarter, collects analytical reports from the administrations and departments of the Association “Uzulgurjisavdoinvest”.

3.4. Reviews letters, applications, suggestion and appeals of the citizens and presents their summaries to the heads of the Association.

IV. MANAGEMENT

4.1. The Department is an independent functional part of the Association “Uzulgurjisavdoinvest”, all of its personnel are appointed and faired by order of the Head Director of the Association.

4.2. The personnel of the  Department carry out their activities within the frame of the position tasks approved by the Head Director of the Association.
